Membership Terms & Conditions

These membership terms and conditions (Terms) outline important information about becoming a Pilates Haus Client. Please be sure to read these Terms and take note of our recommendations and requirements and ask us any questions before you join the membership by agreeing to the Terms. Once you take a class (paid or otherwise), this indicates that you have read and agree to be bound by these Terms.


These Terms are an agreement between Pilates Haus Pty Ltd [ACN 642 335 215[ (We, Us or Our) and you as a student of Pilates Haus (You or Your)


1.     We provide Pilates, Reformer, and Yoga classes (Classes) and operate out of 2/100 Princes Highway, Fairy Meadow (Studio).

2.     We offer a combination of group classes and private classes. These Terms regulate the provision of those classes and we reserve the right to update them (with reasonable notice to you) from time to time.


1.     Health and Wellbeing

1.1    In signing up for Classes and/ or membership with us, you acknowledge and agree that:

  • you are aware that you will participate in physical activity with vigorous stretches;

  • participation in the Classes could constitute a risk of serious injury to you and you agree to waive any claim that you may have against the instructor of the relevant Classes (Instructor) and Us and assume this risk; and

  • if at any time I believe conditions to be unsafe for my child/ children, I will immediately discontinue their participation in the class and seek medical assistance.


1.2     You must inform us if you have any pre-existing injury, illness, muscle soreness, are pregnant or have any other health-related conditions (medical condition) before commencing Classes.  You acknowledge that our Instructors and other team members, whether they be contractors or employees are not medically trained and are unable to assess whether you are in the correct physical condition to safely engage in the Classes.

1.3     Where you have a medical condition or you are in any doubt about your ability to engage in the Classes, we strongly recommend that you seek approval and clearance from a licensed medical practitioner before you participate in any Classes. Participation in any form of exercise or activity at the Studio is done at your own risk.

2.     Personal Items

2.1     No responsibility for your personal items: we are not responsible in any way for the safekeeping of your personal belongings that you bring into our studios. As such, we strongly recommend that you refrain from bringing any valuable personal belongings into our studios, such as mobile phones, jewellery, personal devices, wallets, bags and purses. Bring only any personal belongings into our studios that are absolutely necessary for the duration of your visit. Any personal belongings left behind will be kept in the lost property by the Studio for a maximum of 4 weeks after which time they will be disposed of.

3.     Classes

3.1     Class cancellation policy: We understand that life gets busy, so we are happy for you to change your booking ahead of the scheduled day. If you are a no show or cancel your session late, we are not always able to fill these places. This impacts the flow of the studio and stops others from attending the class who may be on the waitlist. It is for these reasons that if you need to change your booking, we require you to do so at least 3 hours before your booked session so that our Instructors can adapt accordingly. Failure to do so will result in a cancellation fee being incurred. For clients who are on a membership who fail to attend without any notice will incur a $20 cancellation fee For clients who are on a membership who cancel late, within 3 hours of the scheduled class time will incur a $15 cancellation fee. For clients on a casual pass or class pack that cancel within 3 hours of the scheduled class time will be charged the full cost of a single session, forfeit a class credit. All upfront Membership clients you will lose 1 day off your membership for non-attendance or cancelling within 3 hours of the scheduled class. This applies to all of our members.

3.2     Class waitlists: We have live waitlists available to all our clients to improve the availability of our classes. If you are on the waitlist and are no longer able to attend, please remove yourself from the waitlist at least 3 hours prior to the commencement of the class. This is because you are potentially preventing others from attending and to give notice to others to be able to get to the class. You will receive an automatic notification via text or email if you are moved from the waitlist to the class. The 3-hour cancellation policy will still be enforced for clients that are moved from the waitlist into the class.

3.3     Tactile Cueing: You acknowledge that our Instructors may use tactile cueing and adjustment methods, or make physical contact with you for correction purposes in order to ensure that Classes are undertaken in accordance with known practice methods (Practice Methods). The use of these Practice Methods is designed to maintain safe Classes for you, deepen your learning and to grow your capabilities. Participating and engaging in Practice Methods is done entirely at your own risk. 

3.4     Schedule changes: we reserve the right to make changes to the class schedules, opening hours, membership pricing and Instructors at any time at our sole discretion.


4.     Private Sessions

4.1     All one on one private sessions have a 24-hour cancellation policy (Notice Period). Where the Notice Period is not met, you will forfeit your private session.  Note that you can change your private session to another date/time, however, you must give 24 or more notice. 5.     Payment & Fees

5.1     Advanced payment is required to sign up for all classes and private appointments. All of our class purchases (excluding memberships) have expiration time periods. Please bear this in mind; exceptions to this will only be made in extreme circumstances. Payments are made via the GoTeamUp website/APP  CLICK HERE. All bookings are subject to Pilates Haus Cancellation Policy set out at clauses 3 and 4 above with respect to Classes and Private Sessions). You are not permitted to transfer your membership and it remains personal to you.


5.2.    Credit card payment through Stripe will be surcharged 1.75% + 30 cents (subject to change, please refer to Stripe T&C) Direct Debit Payment through Go Cardless will be surcharged 1% + 40 cents (subject to change, please refer to Stripe T&C)


5.3.    Prices listed are inclusive of GST


5.4.    Membership holders can pause their membership for no less than 7 consecutive days, a max of 4 times a year. Requests are to be made in writing a least 7 days in advance to hello@pilateshaus.com.au


6.     Refund Policy

6.1       Subject to the Australian Consumer law, no refunds will be given for change of mind. Any special circumstances will be considered at our sole discretion and only approved at our absolute discretion refunds may be considered and approved by management. You may exchange a service you purchased for another service, but this is not applicable to any equipment or clothing.

7.      Social Media Policy & Release

7.1     We love using social media to share our love of health and fitness, and share updates about our studio and clients, with other users. Once you are a member of Pilates Haus, we will invite you to join our private Facebook group (subject to any rules in that group). We encourage everyone to join us on this platform, however, we do have specific
standards of conduct and behaviour. We will not accept or tolerate any foul language or abusive behaviour. We will block or delete any users or comments that do not comply with these standards.


7.2     We encourage users to share our photos or their own photos of our studio but would ask that we be credited as the owner of these images. We also love sharing your photos of our studio, and your experiences with our classes. We will always credit you as the owner of these images.


7.3     By agreeing to these Terms, consent is given for your photo to be published on our social media platforms and website.

8.     Release

8.1     By agreeing to these Terms, you grant a waiver and release (Release), indemnify, hold harmless and forever discharge Pilates Haus, and its agents, employees, officers, directors, affiliates, successors and assigns, coaches and teachers of and from any and all claims, demands, debts, contracts, expenses, cause of action, lawsuits, damages, and liabilities, of every kind of nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to my participation in the Classes or during a private one on one class at the Studio or loss or damage of personal property as a result of my attendance at the Studio, provided that this waive of liability does not apply to any negligent act or omission by Pilates Haus.


8.2     By providing this Release, I assume any risk, and take full responsibility and waive and of personal injury; death, damage, or loss of personal property, associated with the Classes and/or engaging in any related event or other related activities on and off the Studio Premises.

9.      Whole Agreement

9.1     These Terms contain the entire agreement between you and us and supersedes any prior written or oral agreements between us and the provision of the Release in these Terms will continue in full force and effect even after the termination of the Classes, whether by agreement, by operation of law, or otherwise.

10.     Governing Law

10.1     The laws of New South Wales, Australia, govern these Terms. Any dispute under these Terms will be heard in the courts of New South Wales.
